RESOLUTION Nº 8/2021
COMPOSITION OF THE LIST OF ARBITRATORS

The President of the Chamber of Conciliation, Mediation and Arbitration CIESP/FIESP (Chamber), in the use of the powers conferred by item 4, paragraphs c, d and h[1] of the Internal Regulation of the Chamber;

Considering that the Chamber maintains a list of arbitrators to assist in the appointment of professionals by the parties and by the Chamber, under the Arbitration Rules;

Considering that the Chamber receives a large number of resumes from those interested in joining the arbitrators’ list and that it is the responsibility of the Superior Council and the Presidency of the Chamber to appoint and maintain the list of arbitrators;

Considering the need to improve transparency in the composition of the list of arbitrators, ensuring diversity, experience and effective professional training of its members;

Bearing in mind the comments made during the meeting of the Superior Council and the suggestions then presented; 

Resolves to adopt this resolution, to establish objective criteria regarding the appointment and inclusion in the arbitrators’ list:

 

  • Those interested in applying to be part of the list of arbitrators must express their intention by sending an e-mail to atendimento1.cmasp@ciesp.com.br with the subject “Application to the list of arbitrators”, attaching a resume with a detailed description of their professional experience and academic performance.
  • The Secretariat of the Chamber will send a form to the candidates requesting additional information. This form must be answered by the candidate within a maximum period of 10 (ten) days.
  • The Secretariat of the Chamber will present the list of candidacies and the relevant documents for consideration by the Superior Council and the Chamber Presidency 7 (seven) days before the deliberation meeting. 
  • The Presidency of the Chamber and the Superior Council, for the inclusion of new names to the tables of arbitrators, will consider:
  • Candidate's experience in arbitration, as an arbitrator, lawyer, or expert;
  • Candidate's unblemished reputation;
  • Solid academic background;
  • Promoting gender, racial and regional diversity and fostering the performance of young professionals;
  • Diversification of skills and technical training of the members.

    • Appointments will be made for terms initially of 2 (two) years, being allowed the reappointment of the arbitrator.
    • The list of national arbitrators will be composed of up to 150 (one hundred and fifty) names.
    • Candidates who receive a positive vote from more than half of the Councilors present will be approved to integrate the list of arbitrators, not considering abstention votes.
