COMPOSITION OF THE LIST OF ARBITRATORS
The President of the Ciesp/Fiesp Chamber of Conciliation, Mediation and Arbitration (Chamber), in the use of his powers and the authority conferred under items 4 c), d) and g) [1] of the Chamber’s Internal Rules;
Considering that the Chamber maintains a list of arbitrators to assist in the appointment of professionals by the parties and by the Chamber, under the Arbitration Rules;
Considering that the Chamber receives many resumes from those interested in joining the arbitrators’ list and that, according to the Chamber’s Internal Rules, it is the responsibility of the Thematic Council[2] and the Chamber’s Presidency to appoint and maintain this list[3];
Considering the need to improve transparency in the composition of the list of arbitrators, ensuring diversity, experience, and effective professional training of its members;
Considering the deliberations taken in the meeting of the Chamber’s Thematic Council and the suggestions presented;
Resolves to adopt this resolution to establish objective criteria regarding the appointment and inclusion in the arbitrators´ list:
- From September 1 to October 31 of each year, those interested in applying to join the list of arbitrators must manifest their intention by email to [email protected], with the subject “Application to the List of Arbitrators,” attaching a resume with a detailed description of their professional and academic experience and activity.
- For the 2025 selection process, all applications submitted from January 1, 2025, to November 15, 2025, will be considered.
- The Chamber’s Secretariat will send the candidates a form requesting additional information. This form must be answered by the candidate within a maximum period of 10 (ten) days.
- The Secretariat of the Chamber will submit the list of applications and the pertinent documents for consideration by the Thematic Council and the Chamber’s Presidency 7 (seven) days before the deliberation meeting, which will take place in December.
- The Presidency of the Chamber and the Thematic Council, for the inclusion of new names on the list of arbitrators, shall consider:
- the candidate’s experience in arbitration, as an arbitrator, attorney, or expert;
- the candidate’s integrity and unblemished reputation;
- a solid academic background;
- the promotion of gender, racial, and regional diversity, as well as the encouragement of the engagement of young professionals; and
- the diversification of the skills and technical training of the members.
- The list of arbitrators may be reviewed annually.
- The Chamber will adopt measures to ensure the progressive increase in participation of professionals with the characteristics set out in items 4.4 and 4.5 of item 4, promoting training programs, mentorship, and encouragement of their appointment in arbitral proceedings.
- Candidates who receive positive votes by a simple majority of the Counselors present will be approved for inclusion in the list of arbitrators; abstentions will not be counted.
- The result of the selection process will be communicated via email by the Secretariat of the Chamber. Approved candidates will be included in the list of arbitrators by means of a Presidential Appointment Act.
- Candidates who are not approved may participate in a new selection process in the following year, by submitting a new application.
- This resolution shall enter into force on the date of its publication, revoking Presidency Resolution 8/2021.
